Terms & Conditions
This agreement is a legal agreement between you and www.deliverygenie.com that states the terms and conditions under which you may receive our grocery service. If you choose to use our service you agree to these terms and conditions.
Delivery Genie LLC – Outer Banks local grocery delivery company originally owned and operated since 2005. Delivery Genie LLC (www.deliverygenie.com) currently provides online grocery shopping and delivery service.
2. Hours of Operation and Service Area.
We operate 7 days a week from 9 am to 9 pm. We currently provide our service in Carova, Corolla, Duck, Southern Shores, Kitty Hawk, Kill Devil Hills, Nags Head, South Nags Head and Manteo of North Carolina.
Delivery fees are posted on the main page of our website. Our minimum delivery fee is $40. There is an extra $100 charge for off-road delivery in Carova 4x4 area. There is also an extra 3% non-refundable credit card fee for all credit card payments and 1% non-refundable bank draft fee for bank transfers. Last but not least, there is a $30 fee for the pre-stock option. Our fees, products’ prices, and their availability are subject to change without any notice. However, we do not change or adjust any prices for orders that have been already placed through our website.
4. Placing your order.
All orders must be placed on our website www.deliverygenie.com at any time, but not later than:
3 days before the delivery on weekends and 2 days on weekdays (July, 1 – August, 31);
2 days before the delivery (May, 1 – June, 30 and September, 1 – September, 30);
1 day before the delivery (October, 1 – April, 30).

You must be 21 or older to place an order on our website.
5. Shopping and Delivery.
Our employees will shop and deliver groceries from the order placed on our website www.deliverygenie.com. Delivery will be made to the delivery address specified on your order form. Delivery will occur at the specified delivery time frame. Payment for your order is due by the time of delivery.
Unless you request absolutely no substitutions for your order, we reserve the right to be able to substitute any product in the shopping list with some similar item in case the store does not carry it at the time of purchase.
6. Bill and Payment Options.
Upon delivery you will receive a copy of your invoice, which includes list of groceries along with their quantity and prices, any applicable taxes, delivery fees, credit card/bank draft fee, and discounts, if any. Tip is not included in our service fee.
There are 4 payment options to choose from: credit card (3% non-refundable credit card fee will apply), bank draft (1% non-refundable bank draft fee will apply), mailed-in check (must be mailed at least 5 days prior to the delivery date), or check/cash upon delivery.
Your balance must be paid in full at least 24 hours before the delivery for all in-season orders, except for the weekend orders (May, 1 – September, 30), which have to be paid for 48 hours before the delivery.
All pre-paid orders are qualified to be pre-stocked upon the availability.
For all orders with subtotal over $500 (before taxes and fees) that are going to be paid by check or cash upon delivery, we require 50% deposit. A deposit must be made with a check, credit card, or bank draft at least 24 hours (off-season) to 48 hours (in-season) before the delivery.
7. Returns and Refunds.
You may choose to check your order right at the time of delivery or you will have one hour to do so after your order is received. You have one hour to request a refund or substitution for any damaged or missing item from your order. There is no charge for exchanging damaged items or redelivering missing items. However, no complaints will be accepted after one-hour lapse in time.
In case your order was delivered prior to your arrival to the property, please make sure to check on it the same day and either give us a call or send an email describing an issue, if there is one. A complaint must be submitted by 9pm on the delivery day. No complaints will be accepted at any point after that time!
A refund to your original method of payment will be issued in case some items were not available during the purchase. Your refund will be processed within 3 days after the delivery. For credit card and bank draft payments: money (without credit card or bank draft fee) will be deposited back into the account within 3-5 business days, once the refund is processed. For check payments: a refund will be mailed to the address listed on your original check.
8. Order Cancellation.
You have a right to cancel your order for a full refund at any time, as long as at least 48-hour notice is given. Cancellation fee (30% from your total bill) will be withheld from the refund, if your order is canceled between 24 and 48 hours before the delivery time for all in-season weekend deliveries (May, 1 – September, 30).
There is no refund for any order canceled within 24 hours prior to scheduled delivery time.
9. Customer’s Account.
You agree to provide us with an accurate and complete information as required for registration for our service as well as for placing an order on our website www.deliverygenie.com. This information includes your name, phone number, e-mail, delivery time, and address.
10. Privacy and Security.
Your privacy is important to us, and we want to make you feel comfortable and secure while using our service. We do not sell or rent any of your personal information to third parties.
You may change your personal information by accessing your account at www.deliverygenie.com. You may also request to permanently remove all your personal information stored on our website www.deliverygenie.com.
11. Copyright and Trademark.
All content on www.deliverygenie.com including, but not limited to, web design, text, graphics, interfaces, software and product selection are the property of Delivery Genie LLC. We authorize you to view, copy and print any of our content only for the sole purpose of placing an order with us. Any other use of materials from www.deliverygenie.com, including, but not limited to, reproduction, modification, distribution, or publication for any commercial or public purposes, without the prior written permission of Delivery Genie LLC, is strictly prohibited.
Delivery Genie logo, name, characters, graphics, and button icons are service marks, trademarks, and property of Delivery Genie LLC and may not be used by you for any reason other than as expressly permitted by this Agreement. All other trademarks, service marks, product names, and company names or logos appearing on www.deliverygenie.com are the property of their respective owners.
This Agreement states your entire agreement with Delivery Genie LLC regarding the use of the Delivery Genie grocery delivery service and www.deliverygenie.com.
